These Terms

These are the terms and conditions on which we supply our services to you, which can include coaching, mentoring, programs, courses, walks, resources and digital content.

Please read these terms carefully before you submit your booking to us. These terms tell you who we are, how we will provide services to you, how you and we may change or end the contract, what to do if there is a problem and other important information. Who we are

We are El Camino Ltd, a company registered in England and Wales. Our company registration number is 04420641. Our registered office is at 3 Claire Court, London, N128TD.

1. Coaching & Mentoring Services

Please read through the terms and conditions detailed below. By scheduling your sessions, you are confirming that you have read, understood and agreed to these terms and conditions. If you have questions or concerns, please email enews@heroscamino.com or phone +44 (0) 203 700 9144.

1.1 Client’s Agreement

• I am aware that the Coaching/Mentoring Relationship is in no way to be construed as psychological counselling or any type of therapy. In the event that I feel the need for professional counselling or therapy it is my responsibility to seek a licensed professional. I am aware that the Coaching/Mentoring Relationship is in no way to be construed as business consultancy. In the event that I require same, it is my responsibility to seek such professionals, as I deem necessary. Coaching/Mentoring results are not guaranteed. I enter into Coaching/Mentoring with the understanding that I am responsible for creating my own results.

• I understand that coaching/mentoring can involve brainstorming, the completion of written assignments, goal setting, identifying plans of action, examining lifestyle, questioning, and accountability.

• I give my coach/mentor permission to make specific requests of me at which point I can accept, decline, or modify the request. Once accepted, I agree to be accountable for following through with the action.

• I accept full responsibility for any actions or inactions I may take as a result of coaching/mentoring.

• The coaching/mentoring process can be emotionally strong at times. If the coach/mentor says something or brings up issues that make I feel uncomfortable with and/or I do not wish to discuss, I will let the coach/mentor know at once. The goal is to build a coaching/mentoring relationship that will be open, honest, trusting and truthful.

• I can financially afford the coaching fee at this time. I agree to promptly pay prior to the coaching/mentoring session(s).

• I agree to call/meet my coach/mentor on time. I understand that if I call/meet late & my coach/mentor does not have time open after my appointment, my late arrival will mean that our session will be cut short.

• I understand that 24 hours notice is required to cancel or reschedule an appointment & that I will be charged for a session cancelled with less than 24 hours notice or for no show. All makeup calls/walks/meetings must be completed within the current month.

1.2 Coach’s/Mentor’s Agreement:

• The coach/mentor recognises that the Client may have the following: Future plans, business affairs, customer/client/patient lists and information, financial information, job information, goals, personal information and other proprietary information. The coach/mentor will not at anytime, either directly or indirectly use any information for the Coach’s/Mentor’s own benefit, disclose or communicate in any manner any information to any third party. The coach/mentor will not divulge that the coach/mentor and Client are in a coaching/mentoring relationship without the permission of the client.

• The coach/mentor is committed to the client’s success. If a client makes the coach/mentor aware of a part of the coaching/mentoring relationship that isn’t working, the coach/mentor promises to do what they can to resolve the issue & will appreciate, respect, & value the client’s honesty.

• The coach/mentor will maintain a high level of courtesy and integrity.

• The coach/mentor will be punctual for sessions and give notice of cancellation.

• The coach/mentor will refer the client to appropriate professionals as required.

• The coach/mentor will adhere to strict Standards, Practices and Ethics of the International Coach Federation, a copy of which is available at www.coachfederation.org

• The coach/mentor does not earn referral fees from trainers, recruiters, therapists, counsellors, consultants, or other coaches. Any referral the the coach/mentor makes is exclusively in the client’s interest.

• No reason or cause shall be required to terminate this agreement. If at any time, coach/mentor or client wishes to terminate, the coach/mentor will promptly refund any unearned fees.

1.3 Professional Accreditation Certification

As part of the coach’ ongoing professional development, the hours for these sessions will count towards professional development and further professional coaching accreditation and certification. By signing this agreement, you agree to allow the hours and your contact details to be provided to the coach training school, or the International Coach Federation (ICF), professional coaching association, to meet ongoing Accreditation requirements. These organizations handle all information with the highest regard towards confidentiality.

Agreement to Walks and Walking Programmes Terms & Conditions

The client and the coach/mentor agrees that this agreement will be considered signed when the client schedules and makes payment for their coaching/mentoring session. This shall be treated in all respects as having the same effect as an original signature.

2. Walks and Walking Programmes

A booking can be considered as confirmed once full payment and completed booking forms have been received by El Camino Ltd and we have issued you with an invoice receipt. This invoice receipt forms the contract between El Camino Ltd and the client(s) and comes into effect from the date the invoice recept is issued.

Prior to the start of any walk activity of over one day in duration you will be required to complete and sign a booking registration form providing details of emergency contacts and any medical conditions the leader needs to be aware of together with the declarations included at the end of this document.

2.1 Alterations

El Camino Ltd will always do their best to accommodate reasonable requests to alter your booking such as a change to the names of clients included in your booking or, in the case of private guiding, a change to the itinerary. If there are associated costs relating to such a change we reserve the right to discuss these costs with you and make an additional charge for them if the alteration is agreed.

2.2 Cancellations

For Walking Programmes greater than 1-day in duration, we strongly recommend clients consider taking out appropriate cancellation insurance. In the event of a booking being cancelled by a client, El Camino Ltd will refund the client as follows:

Walking Programmes greater than 1-day in duration

  • Cancellations more than 30 days from the start of the programme will receive a 75% refund, excluding any additional costs incurred by El Camino Ltd for accommodation, or the option to change to an alternative date that we can accomodate.

  • Cancellations 30 days or less from the start of the programme will not be refunded.

Walks less than 1-day in duration

  • Cancellations 24 hours or less from the start of the walk will not be refunded.

In exceptional circumstances El Camino Ltd may need to cancel your booking. If El Camino Ltd cancels your booking you will have a choice of receiving a full refund or changing your booking to an alternative date or programme of equal value. If you prefer to change to a programme of a higher value you will be required to pay the difference. We will not be liable for any additional costs or expenses incurred as a result of such a cancellation.

Group walks operate with a minimum number of 4 participants. If you are the only person to book on a walk or course we may contact you to offer you the choice of swapping to an alternative date to receive a full refund.

Private guiding and other bespoke activities have no minimum numbers.

2.3 Bad Weather & Other External Factors

Walks will generally take place regardless of the weather on the day unless the leader considers that conditions could compromise the safety of the group. No refunds will be made if a client decides to cancel as a result of weather conditions.

Other factors such as, but not limited to, landslides, flooding, footpath and rights of way restrictions can also impact the ability to undertake a planned itinerary. As a result, changes may need to be made at the leader’s discretion. We reserve the right to make changes to the itinerary or to cancel the booking where appropriate or for safety reasons.

2.4 Leader Authority & Client Behaviour

When taking part in a walk or walk programme you must abide by the authority of the leader. If you commit any illegal act or in the reasonable opinion of the leader your behaviour is likely to be disruptive, threatening, abusive, a danger to yourself or causing or likely to cause danger, distress, damage to property or annoyance to others or the leader, or if you are under the influence of drugs or alcohol then we may terminate your participation in the walk or walk programme without any liability on our part.

This includes clients who fail to advise us of medical conditions or disabilities or have an insufficient level of fitness which prevents their participation in the activity or adversely impacts the ability of other clients to participate in the walk or walk programme as planned. This also includes clients who, in the opinion of the leader, are not appropriately equipped or clothed to safely participate in the activity or who do not follow the recommended covid-19 social distancing or do not have hand sanitiser.

2.5 Parental Responsibility

Children under the age of 18 are only accepted by prior agreement on our walks and programmes. Any people under the age of 18 must be accompanied by THEIR parents or legal guardians who agree to take full responsibility for their actions and safety and supervision of them at all times, also ensuring that they follow social distancing guidance. This means people under 18 being within sight and sound of their parent or legal guardian and under their control at all times. You also confirm that your child has the relevant fitness and/or experience to participate in the walk and that you accept the risks for your child and give consent for them to take part.

2.6 Insurance, Risk and Liability

El Camino Ltd will take all reasonable measures to ensure your safety.

Please note however that outdoor activities including walking involve risk and have a danger of personal injury or death. Anyone taking part shall be aware of, and accept these risks, and agree to be responsible for their own actions and involvement and to raise any concerns or questions with the leader.

El Camino Ltd has full public and professional liability insurance, and we advise you to take out your own personal accident and liability insurance and appropriate cancellation insurance. If you already have insurance cover, please check that it covers you for the walking activity you are undertaking.

Our website, social media, emails and printed materials are to our best knowledge accurate and produced in good faith. Clients must have a good written and spoken understanding of English so as to understand the information and risks of their activity and information or guidance provided by the leader on the day. El Camino Ltd cannot take responsibility for any misunderstandings resulting from a client not reading or understanding this information. El Camino Ltd cannot accept responsibility for any loss or damage to your personal effects, property or vehicles during a walk or walking programme.

2.7 Dogs

El Camino Ltd does not normally accept dogs other than registered assistance dogs on group walks or programmes. If you wish to bring a dog on a one-to-one walk or walk programme, please advise us of this prior to booking so we can discuss whether this can be accommodated.

2.8 Health and Fitness

Bookings are accepted on the understanding that you and those you are booking on behalf of are medically and physically fit for the activity to be undertaken and that you and those you are booking on behalf of have obtained medical advice about the suitability to undertake the activity where appropriate.

We ask clients to inform the walk leader if they suffer from any allergies, medical conditions, disabilities or injuries. If a client’s health and fitness situation changes after making the booking they should make us aware of such changes.

Allergies

If your booking includes food, please ensure that any food allergies and/or dietary requirements are clearly highlighted to El Camino Ltd at the time of booking so these details can be passed on to the business providing the food so they can see if they are able to adapt a dish to accommodate allergies or intolerances. These requirements must also be highlighted by the client to the walk leader at the start of the walk and to the business providing the food on arrival at their premises.

2.9 Complaints

El Camino Ltd takes pride in the service it provides to our clients. However, if you are unhappy, any complaint should first be made to your walk leader, as soon as possible, and ideally at the time. Your walk leader will endeavour to find a solution that is acceptable to you but must also consider the group as a whole. If for some reason the problem is not resolved to your satisfaction then you should put it in writing and send to our contact address or email us within 4 weeks of the end of your walk or walking programme. All complaints will be fully investigated and we will keep you informed.

2.10 Declarations

Participation Statement

I and those I am booking on behalf of understand that outdoor activities including walking involve risk and have a danger of personal injury or death. Anyone taking part shall be aware of, and accept these risks, and agree to be responsible for their own actions and involvement and to raise any concerns or questions with the leader.

I and those I am booking on behalf of will participate in a responsible manner, conscious both of our own safety and of the impact of our conduct on the safety of others, and hold in mind our individual duty of care to all in our company.

Equipment & Clothing

I and those I am booking on behalf of have read the recommended equipment and clothing for walks and walking programmes and confirm that I/we will come appropriately equipped and clothed for the weather on the day including appropriate footwear with good grip. I will also bring my own hand sanitiser for use during the activity. If in doubt please contact us to discuss.

Medical disclaimer

I confirm that I and those I am booking on behalf of are medically and physically fit for the walking activity to be undertaken and that you and those you are booking on behalf of have obtained medical advice about the suitability to undertake the activity where appropriate.

I and those I am booking on behalf understand the importance of notifying the walk leader of any medical conditions, disabilities, injuries, allergies or medications that will be carried that they should be aware of. This is in order that they can deal more effectively with any emergencies.

Photographs

Photos of our clients may be used in El Camino Ltd’s publicity, on our website or on our Social Media. Please indicate on the registration form if you or any member of your group are not happy for this to happen.

Agreement to Walks and Walking Programmes Terms & Conditions

By making a booking I confirm that I agree that I have read and understood and accept the terms and conditions.

3. Online Programmes and/or Taught Courses

3.1 Definitions

“Confidential Information” means information provided by one party to the other in written, graphic, recorded, machine readable or other form concerning the business, clients, suppliers, finances and other areas of the other party’s business or products, including, without limitation, the Programme and/or Course Materials, but does not include information in the public domain other than through the default of the party disclosing the information, information required to be disclosed by any court or regulatory authority, or any information already in the possession or control of the disclosing party.

“Programme and/or Course Materials” means the information provided by El Camino Ltd to accompany a course provided as part of the Services in hard copy or electronic form.

“Fees” means the fees paid by you to El Camino Ltd for the Services.

“Intellectual Property Rights” means copyright, rights in or relating to databases, patent rights, performers’ rights, designs and registered designs, trademarks, rights in or relating to Confidential Information and other intellectual property rights (registered or unregistered) throughout the world.

“Online Programme” means the delivery by us of an online course pursuant to which you learn course materials remotely.

“Services” means the provision of the Online Programme and/or the Taught Course and/or the Course Materials together with such other services as agreed from time to time and purchased by you through the Website or by telephone.

“Taught Course” means a course taught by us in a classroom setting to which you attend in person.

3.2 The Services

3.2.1. A description of the Services together with the dates on which the Services will begin are available on our Website.  We will provide the Services with reasonable care and skill in accordance with the description set out on the Website.

3.2.2. We reserve the right to vary or withdraw any of the Services described on the Website without notice.

3.2.3 We expect you to confirm that the Services you are purchasing will meet your needs.  We do not make any guarantee to you that you will obtain a particular result, professional qualification or employment opportunity from your purchase and completion of any of the Services.

3.3 Ordering Services

3.3.1. To purchase a Service over the telephone please call +44 (0) 203 700 9144.

3.3.2. When you place an order for a Service via the Website, or telephone you are offering to purchase the Services on these terms and conditions.  El Camino Ltd reserves the right to cancel or decline your order or any part of your order at any time until it has been confirmed in accordance with clause 3.3.4 below.

3.3.3. Following receipt by us of your order for Services via the Website or on the telephone we will contact you confirming receipt of your order. 

3.3.4. A legally binding agreement between us and you shall come into existence when we have :
(a)    accepted your offer to purchase Services from us by sending you confirmation of the purchase; and
(b)    received payment of the relevant Fees from you in accordance with clause 3.5 below. 

3.4 Cancellation and Variation

4.4.1. Subject to clause 4.4.2 below, where we have accepted / confirmed the Services being purchased by you and formed a legally binding agreement with you in accordance with clause 3.3.4. above, then you are permitted within 14 working days starting on the day after the date we have concluded our agreement in accordance with clause 3.3.3, to cancel your purchase of the Services. 

4.4.2. If you have purchased an Online Programme and have already accessed, downloaded all or part of the Online Programme and/or started to use that Online Programme then you shall have no right to cancel your order.

4.4.3. Notwithstanding clause 4.1 there is no other right to cancel or vary your purchase of Services and any other cancellation and / or variation of course dates will be at the entire discretion of El Camino Ltd.

3.5 Fees

3.5.1. The Fees for the Services shall be as set out on the Website or as told to you over the telephone at the time you placed an order for them. 

3.5.2. Unless otherwise specified at the time you purchase the Services the Fees are exclusive of VAT or other local taxes, the cost of some Programme/Course Materials and any delivery costs payable in respect of the delivery of Programme/Course Material to you.  Each of these costs will be set out in the Website or told to you over the telephone prior to your purchase the Services.

3.5.3. Fees for the Service selected by you on the Website or purchased over the telephone shall be debited from your credit / debit card at the time of purchase.  Fees must be paid in full prior to you attending any Taught Course or accessing any Online Programme.

3.5.4. Any fees charged by your debit or credit card provider in connection with your purchase of Services are for your own account and El Camino Ltd shall not be responsible for these.

3.5.5. You shall be responsible for all costs you incur in connection with your attendance at any Taught Courses or your access onto any Online Programme.

3.6. Liability

3.6.1. No part of the provision of the Services shall be deemed to be, nor is it intended to be, nor should it be taken to be, the provision of investment advice.

3.6.2. Although El Camino Ltd aims to provide the Services to the highest standards of the industry, neither it, nor its trainers accept any liability for (i) any inaccuracy or misleading information provided in the Programmes or Course Materials and any reliance by Client on any such information, (ii) any loss or corruption of data, (iii) any loss of profit, revenue or goodwill, or (iv) any indirect, special or consequential loss arising from any breach of the terms of this Agreement.

3.6.3. Except to the extent that they are expressly set out in these terms and conditions, no conditions, warranties or other terms shall apply to the Services.  Subject to clause 3.6.5 no implied conditions, warranties or other terms apply (including any implied terms as to satisfactory quality, fitness for purpose or conformance with description).

3.6.4. Subject to clause 3.6.5 below, El Camino Ltd's total liability arising from or in connection with these terms and conditions and in relation to anything which we may have done or not done in connection with these terms and conditions and the delivery of the Service (and whether the liability arises because of breach of contract, negligence or for any other reason) shall be limited to the Fees received by us in connection with the relevant Online Programme or Taught Course in relation to which a dispute has arisen.

3.6.5. Nothing in this Agreement shall exclude or limit El Camino Ltd’s liability for (i) death or personal injury caused by negligence, (ii) fraudulent misrepresentation or (iii) any other matter which under English law may not be limited or excluded.

3.6.6. No claim may be brought more than six months after the last date on which the Services concerned have finished or ceased to be provided by us.

3.7. Intellectual Property

3.7.1. All Intellectual Property Rights in the Course Materials, Online Programme and the speeches made by trainers at the Taught Courses are, and remain, the intellectual property of El Camino Ltd or its licensors, whether adapted, written for or customised for the Client or not.

3.7.2. You are not authorised to:-

(i) copy, modify, reproduce, re-publish, sub-licence, sell, upload, broadcast, post, transmit or distribute any of the Course Materials without prior written permission;

(ii) record on video or audio tape, relay by videophone or other means the Online Programme or Taught Course given

(iii) use the Course Materials in the provision of any other course or training whether given by us or any third party trainer;

(iv) remove any copyright or other notice of El Camino Ltd on the Course Materials;

(v) modify, adapt, merge, translate, disassemble, decompile, reverse engineer (save to the extent permitted by law) any software forming part of the Online Programmes.

Breach by you of this clause 3.7.2 shall allow us to immediately terminate these terms and conditions with you and cease to provide you with any Services, including but not limited to access to the Online Programmes.

3.7.3. In consideration of the Fees paid by you, we grant to you a limited, non-transferable, non-exclusive licence to use the Course Materials for the sole purpose of completing the Online Programme and / or attending the Taught Course.

By clicking on the ‘Book Now’ button I confirm that I agree that I have read and understood and accept the terms and conditions.

4. Changes to the Terms and Conditions

We reserve the right to change these Terms and Conditions at any time. Please check back regularly because the amended Terms and Conditions. Certain provisions may be extended or superseded by expressly designated legal notices or terms located on particular pages of the website.

5. Governing law

These Terms and Conditions shall be governed by the laws of England and any dispute arising from these Terms and Conditions or your use of the website shall be subject to the exclusive jurisdiction of the English courts.

6. Material on the website

Material on the website is provided for information purposes only. Whilst every care is taken in compiling the information on the website we do not make any warranties or representations as to its accuracy or reliability. We may make changes to the material on the website at any time without notice. Certain information on the website may contain typographical or other errors or be out of date, and we make no commitment to update such information. We and any third parties referred to on the website assume no responsibility for how you use the information provided through the website.

7. Website Links

Where we provide links to other websites, we do so for information purposes only. We are not responsible for the content of any other websites or pages linking to or from our website. We have not verified the content of any such websites and links to other websites do not imply any endorsement of the material on those websites. If you choose to follow links to other websites you do so at your own risk. It is your responsibility to take all protective measures to guard against viruses or other destructive elements. We accept no liability for any statements, information, products or services that are published on or are accessible through any websites owned or operated by third parties.

If you establish a link to our website you do so at your own risk. Such a link in no way implies any relationship between El Camino Ltd and any third party and we in no way endorse the content contained on any third party web site or their other published material.

You are required to obtain permission from El Camino Ltd prior to you making any use of the El Camino Ltd logo and/or making any statement which implies that the El Camino Ltd has any relationship with you and/or in any way endorses you and/or your website and/or any public statement that you may make. 

8. Use of the website and copyright

You may access, view and print copies of material contained in the non-password protected parts of the website as long as you comply with these Terms and Conditions and:

  • you agree to use this site only for lawful purposes and in a manner which does not infringe the rights or restrict or inhibit the use and enjoyment of the site by any third party;

  • you use the material for information purposes and for your non-commercial, personal use only;

  • all copyright, trade mark and other proprietary notices are kept on the material; and

  • you do not modify, reproduce, display or distribute the material without prior written consent from El Camino Ltd

Commercial use or publication of all or any material is strictly prohibited without prior authorisation from the El Camino Ltd. Nothing contained herein shall be construed as conferring any license by the El Camino Ltd to use any item displayed.

9. Website Liability

Neither we, nor any other party involved in creating, producing, maintaining or delivering the website, will be liable for any amount or kind of loss or damage that may result to you or a third party including without limitation any loss of income, profits, goodwill, data, contracts, use of money, or loss or damages arising from or connected in any way to business interruption, whether in tort, contract or otherwise (including without limitation negligence) in connection with:

  • your use, inability to use or the results of use of the website, any websites linked to the website or the material on such websites; or

  • any amount or kind of loss or damage including without limitation any loss or damage due to viruses that may infect your computer equipment, software, data, or other property on account of your access to, use of or browsing the website or your downloading of any material from the website or any websites linked to the website.

In so far as we are able we exclude all liability for all direct, indirect, punitive or consequential loss or damage which arises out of or in connection with the use of the website.

Nothing in these Terms and Conditions shall exclude or limit our liability for death or personal injury caused by negligence (as such term is defined by the Unfair Contract Terms Act 1977), fraud, or misrepresentation as to a fundamental matter.

If your use of the website results in the need for servicing, repair or correction of your equipment, software or data, you assume all costs of this.
